What sentence would I receive for an offence of drink driving?

Basic penalties for drink driving 

This will depend upon the level of alcohol in your breath or blood.

First offence sentencing ranges

The minimum is a 12 month driving ban with accompanying fine for a first offence up to a maximum of a  sentence of imprisonment starting at 12 weeks and a 3 year ban as a maximum.

Repeat offences and higher penalties

For a second offence within 3 years the lowest penalty is a 3 year ban and a fine up to a maximum unlimited ban and sentence of imprisonment exceeding.

Aggravating and mitigating factors

A large factor within the sentence that you receive will be the level of aggravation within the offence and the level of mitigation available to you. Examples of good mitigation include a guilty plea, driving for an emergency, driving a very short distance (eg merely moving the car to park it) or if your drinks were spiked.
