What sentence would I receive for an offence of drink driving?
This will depend upon the level of alcohol in your breath or blood. The minimum is a 12 month driving ban with accompanying fine for a first offence up to a maximum of a sentence of imprisonment starting at 12 weeks and a 3 year ban as a maximum. For a second offence within 3 years the lowest penalty is a 3 year ban and a fine up to a maximum unlimited ban and sentence of imprisonment exceeding. A large factor within the sentence that you receive will be the level of aggravation within the offence and the level of mitigation available to you. Examples of good mitigation include a guilty plea, driving for an emergency, driving a very short distance (eg merely moving the car to park it) or if your drinks were spiked.
