SP Ltd are a large property management company based in the South East of England. They were accused, as a corporate entity, of a breach of s172 of the Road Traffic Act 1988 in respect of failure to provide driver’s information relating to their company fleet of vehicles. The Directors of the company were very concerned about the prosecution; the company had to pass various checks due to their areas of operation and any criminal offence recorded against the company could have seriously affected their operations and ability to effectively tender for contracts. They therefore instructed Quentin Hunt to act for the company on a Direct Access basis.

 

Upon instruction Quentin set about finding out how the allegation had been made against the company. Upon taking full instructions from the Directors Quentin came to the view that the allegations could be defeated with the right evidence being collected. He therefore set about interviewing Directors and members of staff and collecting section 9 MCA witness statements together with associated exhibits. Upon completion of this exercise Quentin had assembled a powerful body of evidence to demonstrate the Company’s innocence.

 

The matter was listed for first appearance at the Peterborough Magistrates’ Court and Quentin appeared on behalf of the Company’s behalf pursuant to s46 and schedule 3 of the Magistrates’ Courts Act 1980 and s33(6) of the Criminal Justice Act 1925 which meant that the Directors did not need to take time out of their diaries to appear personally.

 

Upon appearance at Court Quentin presented the prosecution with a large body of the evidence that he had collected; he made forceful arguments that the case should not continue. The prosecution reviewed their case and agreed with Quentin’s submissions. The case was therefore discontinued and a Not Guilty verdict was entered in respect of the company. Quentin also made a cost application which was successful and meant that the costs incurred by the Company in its defence were to be met.
