Quentin achieves Not Guilty verdict at Lewes Crown Court in Perverting the Course of Justice case
Quentin Hunt acted for Miss CR who was accused of perverting the course of justice via the provision of false details on a notice provided by police under section 172 of the Road Traffic Act 1988. Miss CR was said to have falsely put the details of a foreign national on the form that she returned to police. The prosecution case was that the person who was nominated on the form did not exist and that Miss CR invented them in order to avoid getting points on her driving license.
Miss C.R. disputed the case and stated that the person who was nominated on the form did exist and was driving the motor vehicle. Although cell site analysis of her mobile telephone showed that she was in the car, she denied that she was in fact the person driving and maintained that it was a relative of hers that was visiting her.
The matter proceeded and Miss C.R. faced a trial at the Lewis Crown Court. At the trial, Quentin rigorously defended Miss CR's interests. He cross-examined the police officer who gave evidence on behalf of the prosecution in respect of the adequacies of the checks made by the police. This included issues relating to the sufficiency of immigration checks, photographs taken of the vehicle, searches on databases within the UK, and errors relating to inquiries made in foreign jurisdictions.
At the conclusion of the case, Quentin made a submission of no case to answer to the judge that the case could not continue as the police had not established a prima facie case against his client.
The judge agreed and and ordered that the jury enter a Not Guilty verdict against Quentin's client who was delighted with the result of the case.
